Almost every fraud case involving an NRI's property in India traces back to the same root cause: a General Power of Attorney (GPA) that was signed too casually and gave the holder far more authority than the situation ever required. Understanding the difference between a GPA and a Specific Power of Attorney (SPA) — sometimes called a Special Power of Attorney — is the single most important decision in this entire process.

The mechanics are broadly the same whichever country you are executing from — only the attestation step (apostille or consulate) changes, as covered in the next section.

HOW LONG DOES IT TAKE?

Drafting typically takes 1–3 business days once we have your details. Notarisation and apostille turnaround varies by country and state — often 2–10 business days in the USA, UK, Australia, and Singapore, and slightly longer through Global Affairs Canada. Add courier time (5–10 days) and stamping/registration in India (a few days to a couple of weeks depending on the Sub-Registrar's workload). Most straightforward property SPAs are drafted, executed, and registration-ready within 3 to 5 weeks end to end; urgent matters can often be compressed with advance planning.

Attestation Route by Country — USA, Canada, UK, Australia, Singapore & UAE

Five of the six countries we work with most often for NRI clients are members of the Hague Apostille Convention, 1961, which means a single apostille certificate makes your POA legally recognisable in India without any visit to an Indian Embassy or Consulate. The UAE is the important exception — it has not acceded to the Hague Convention, so a POA signed there follows a different route entirely.

What an Apostille Actually Certifies

An apostille is not a review of what your POA says. It's a standardised certificate — recognised by every Hague Convention member country, India included — that authenticates the signature and seal of the notary or official who witnessed your signing. Once attached, India must accept the document as authentic without any further legalisation step, which is why the apostille route is faster than the older embassy-attestation chain.

This is also why a POA notarised in the UAE cannot simply be sent for an apostille — the UAE has not joined the Hague Convention, so there is no apostille authority there. The document must instead go through consular channels, which is why we recommend UAE-based clients execute the POA directly at the Indian Embassy or Consulate rather than notarising locally first.

For USA, Canada, UK, Australia, and Singapore clients: the apostille is issued by a state or national authority — for example, the Secretary of State of the specific US state where you were notarised — and cannot be obtained from a different office, so plan drafting and notarisation together with the correct apostille authority in mind.

Common Mistakes That Get a POA Rejected at the Sub-Registrar

Under Sections 71 and 72 of the Registration Act, a Sub-Registrar can refuse to register a document and must record the reasons in writing. POAs are refused more often than most NRIs expect — the most common causes are entirely avoidable:

A Real-World Example (Illustrative)

The Situation: An NRI client in New Jersey inherited a share of ancestral agricultural land in Punjab jointly with two siblings still in India. A buyer had come forward, but the client couldn't take extended leave to travel — and an earlier draft, a broad GPA sent over by a local property agent, would have let the holder deal with the client's other India-based bank accounts too, far beyond what was needed.

What We Did: We redrafted it as a narrow SPA limited strictly to the sale of the named plot at an agreed minimum price, naming a sibling as attorney-in-fact. The client signed before a Notary Public in New Jersey, obtained an Apostille from the New Jersey Secretary of State, and couriered the original to us. The Outcome: The sale deed was registered without the client ever travelling to India, and proceeds were later repatriated in compliance with FEMA. Because the SPA was scoped to one transaction, the client's other India-based assets were never exposed to the attorney-in-fact's authority.

Yes. The USA, Canada, the UK, Australia, and Singapore are all members of the Hague Apostille Convention, so a POA notarised there and issued a Hague Apostille is legally recognisable in India without any further Indian Embassy attestation.

Does a Power of Attorney executed in the UAE need Indian Consulate attestation instead of an apostille?

Yes. The UAE has not acceded to the Hague Apostille Convention, so a UAE-executed POA cannot be apostilled. Instead, it should generally be executed directly before a Consular Officer at the Indian Embassy in Abu Dhabi or the Indian Consulate in Dubai as a consular act.

What is the difference between a Specific Power of Attorney (SPA) and a General Power of Attorney (GPA)?

An SPA is limited to a named property and a specific transaction, such as the sale of one particular plot, and cannot be used beyond that scope. A GPA grants broader, often open-ended authority and is the instrument most commonly misused in property fraud, which is why we recommend a narrow SPA in almost every case.

Can a Power of Attorney be revoked once it is executed?

Yes. A POA can generally be revoked at any time by executing a written, ideally registered, revocation deed, which should be communicated to the attorney-in-fact and to any bank, Sub-Registrar, or other authority that may rely on the original POA. A GPA coupled with a financial interest of the holder may be irrevocable under Section 202 of the Indian Contract Act — this should always be checked before drafting.

How long is a Power of Attorney valid for in India?

Indian law does not fix a universal expiry date for a POA — it generally remains valid until revoked, until the specific transaction it authorises is completed, or until the death of either party, unless the document itself states a validity period. In practice, we recommend building a defined validity period into property SPAs, since banks and Sub-Registrars are often cautious about acting on a very old POA.

What happens if my Power of Attorney is rejected at the Sub-Registrar's office?

The Sub-Registrar must record the reasons for refusal in writing under Section 71 of the Registration Act. You can then appeal to the Registrar under Section 72, or in some cases seek a civil court direction to compel registration under Sections 73–75 — both of which take significant time, which is why advocate-reviewed drafting before signing is strongly recommended.

Do I need to send the original Power of Attorney to India, or is a scanned copy enough?

The original, apostilled or consulate-attested POA generally needs to reach India — Sub-Registrars typically require the original document for registration and verification. A scanned copy is useful for early review and drafting but cannot substitute for the courier of the original.
