Almost every remote transaction an NRI in the UAE needs to complete in India — selling a flat, closing an ancestral property matter, operating a bank account, or appearing in a court case — runs through one document: the Power of Attorney. Executed loosely, through the wrong office, or without the exact wording a Sub-Registrar expects, the transaction stalls in India while you remain in Dubai, Abu Dhabi, or Sharjah. Grants broad, often open-ended authority — to manage "all my affairs in India," sign any document, or operate any account. It is convenient to arrange quickly, which is exactly why it is also the instrument most often forged or stretched well past what you actually agreed to.

We do occasionally draft a GPA for a UAE-based client — typically where an elderly parent's day-to-day affairs need continuous management by a fully trusted family member. Even then, we build in an explicit list of permitted acts, a validity period, and a revocation clause rather than leaving the authority unlimited. For a one-time sale, a bank matter, or a specific litigation, an SPA is almost always the safer instrument, and it also happens to be quicker to process through either UAE execution route, since the wording being reviewed by the Consular Officer or the MOFAIC desk is narrow and unambiguous.

The Older Alternative: UAE Notarisation Plus MOFAIC and Embassy/Consulate Attestation

Some clients still ask for the older, longer route — either because a particular bank or Sub-Registrar has specifically asked for it, or because a same-week Embassy or Consulate appointment is not available. That route runs: sign the SPA before a notary public at Dubai Courts, Abu Dhabi Judicial Department, or another authorised UAE notarisation channel; have the notarised document attested by the Ministry of Foreign Affairs and International Cooperation (MOFAIC); and then have the MOFAIC-attested document attested a second time by the Indian Embassy in Abu Dhabi or Indian Consulate in Dubai. It reaches the same legal destination, but adds an extra government office and typically a week or more of extra time compared with executing directly before the Consular Officer in the first place.

Why the UAE Is Different From Hague Apostille Countries

NRIs based in the USA, UK, Canada, Australia, or Singapore follow a much simpler route: sign before a local notary, then obtain a single apostille certificate from the appropriate state or national authority, and the document is instantly recognisable in India without any further legalisation. That is only possible because those countries — and India — are members of the Hague Apostille Convention, 1961. An apostille is a standardised certificate that authenticates the signature and seal of the notary who witnessed the signing; once attached, the receiving country must accept the document as authentic without any additional step.

The UAE has never acceded to the Hague Apostille Convention. There is, quite simply, no apostille authority in Dubai, Abu Dhabi, or anywhere else in the country — no office issues one, and no amount of extra notarisation makes a UAE-signed document eligible for one. A UAE-executed Power of Attorney must instead travel through consular channels, which is exactly why we recommend executing it directly before a Consular Officer at the Indian Embassy in Abu Dhabi or the Indian Consulate in Dubai in the first place, rather than notarising locally and hoping an apostille can be added later — it cannot.
