Why Qatar-Based NRIs Need This
Qatar is home to one of the Gulf's largest and steadiest Indian communities, drawn from Kerala, Tamil Nadu, Andhra Pradesh, Telangana, and Punjab, working across energy, construction, healthcare, hospitality, and finance. For a large share of that community, decades of savings sent home have gone into land, an apartment, or an extension to the family house — property that sits unattended for months or years at a stretch between visits. You cannot walk past your own plot on the way to work in Doha, drop in on a tenant unannounced, or notice a boundary marker that has quietly shifted. Every check a resident owner performs without thinking has to be delegated from a distance, and delegation is exactly where fraud finds room to operate.
A dedicated NRI property lawyer for Qatar residents replaces that gap with a structured process: verified title records, a properly attested Power of Attorney, and a legal team on the ground in India who report back on your schedule, not theirs. Whether the matter is a purchase you want checked before wiring funds from Doha, a partition dispute among siblings scattered between Al Wakrah and Kerala, or a builder who has gone silent on a flat booked years ago, the approach stays the same — clear documentation, remote-first execution, and a lawyer who understands that your working week runs on Arabia Standard Time, not Indian Standard Time.
Core Property Services for Qatar NRIs
Our practice covers every stage of owning, defending, or exiting Indian property from Qatar — before a purchase, during a dispute, and through to final resolution.
Property Purchase & Sale Review
Sale agreement drafting and review, stamp duty and registration guidance, and payment-structure advice so funds move correctly under FEMA before you commit a single riyal or rupee.
Title Verification & Due Diligence
A thirty-year title trace, encumbrance certificate check, and revenue-record match against the seller's claimed ownership, delivered as a plain-language report you can act on from Doha.
Encroachment & Illegal Possession Recovery
Summary suits under Section 6 of the Specific Relief Act for recent dispossession, and title-based recovery suits with an interim injunction for older encroachment or a relative who has overstayed a caretaking arrangement.
Ancestral Property Disputes
Representation where inherited land is disputed among heirs, wrongly mutated in someone else's name, or claimed under a will or family settlement you were never shown.
NRI Builder Fraud & RERA Complaints
Complaints before the state Real Estate Regulatory Authority for delayed possession, diverted funds, or units sold twice, plus consumer-forum action for older, pre-RERA bookings.
Property Partition Suits
Formal division of jointly held or ancestral property among co-owners, filed and pursued through to a registered partition deed while you stay in Qatar.
Power of Attorney for Property — The Qatar Attestation Route
If you take one thing away from this page, make it this: Qatar is not a Hague Apostille Convention member, so a Power of Attorney signed in Doha or anywhere else in Qatar cannot be apostilled for use in India. NRIs in the USA, UK, or Singapore can get a document apostilled in a single step; a document executed in Qatar instead has to pass through a government attestation chain, and a POA that skips this chain will be rejected the moment you try to register a sale deed or file a suit in an Indian court.
The Standard Chain: Notarisation → MOFA → Indian Embassy

- Drafting: We draft a Special Power of Attorney naming the exact property and the specific acts it authorises — never a broad, open-ended General Power of Attorney with unrestricted sale rights.
- Qatari Notarisation: You sign before a notary at the Ministry of Justice's Documentation and Notarisation Department in Doha, or another authorised Qatari notarisation channel.
- MOFA Attestation: The notarised document is submitted to Qatar's Ministry of Foreign Affairs (MOFA) for authentication.
- Indian Embassy Doha Attestation: The MOFA-attested document is then attested by the Embassy of India, Doha, which covers the whole of Qatar — there is no separate consulate to route to.
- Dispatch & Adjudication: The fully attested original is couriered to India, where it must be adjudicated at the relevant Sub-Registrar's office within 90 days of arrival, failing which a multiple-rate penalty applies before it can be used for a property transaction.
The Faster Option: Direct Embassy Attestation
For a purely property-focused POA, many of our Qatar clients instead sign in person at the Embassy of India's attestation counter in Doha, where a Consular Officer or authorised agent witnesses the signature and attests it directly — usually without a separate MOFA step first. Carrying your original passport to that appointment, this route commonly completes in two to five working days against the two-to-three weeks the full MOFA chain typically takes, and is worth checking first for a time-sensitive sale or possession suit. What is never available, whichever route you take, is an apostille — Qatar has simply not acceded to the Hague Convention, and no document executed there can carry one.
PROTECT YOURSELF
Use a Special Power of Attorney limited to one property or transaction rather than a General Power of Attorney. Register it at the Indian Sub-Registrar's office, direct that any sale proceeds be deposited only into your own NRE or NRO account, and formally revoke any older POA you no longer use before it can be misused. See our dedicated guide on Power of Attorney & attestation for NRIs for the full document checklist.
Property Problems We See Most From Qatar-Based Clients
Working with Qatar's Indian diaspora for over two decades has shown a consistent pattern — the risk rarely comes from anything the owner did wrong, but from the simple physical distance between a demanding Gulf career and a piece of land back home.
Remittance-Funded Property, Unchecked at Purchase
A common pattern among Kerala, Andhra Pradesh, Telangana and Punjab families: years of Gulf remittances go into buying land or a house through a relative on the ground, with the actual title, encumbrance status and boundary never independently verified.
Ancestral Property Disputes Back Home
Siblings and cousins who stayed in India, and siblings who left for the Gulf decades ago, often hold very different — and undocumented — understandings of who is entitled to what share of the family land.
Absentee Ownership Exploited by Caretakers
A "trusted" relative or neighbour asked to keep an eye on a vacant plot sometimes rents it out, sells produce from it, or worse, uses an old Power of Attorney to attempt a sale the owner never authorised.
Encroachment Discovered Only on Rare Visits
Because most Qatar-based NRIs visit India once a year, sometimes less, a boundary wall moved, a shed built on the plot, or a tenant who simply stopped paying rent can go unnoticed for a very long time.
Handled on Arabia Standard Time
None of this needs a flight back. Consultations, document review and case updates are scheduled around your AST working hours or evenings, with execution in India carried out under your Power of Attorney.
One Point of Contact, Not Five Relatives
Where family members are split between Qatar and different Indian states, we act as the single coordinating point — rather than the matter depending on whichever relative happens to be free that week.
Repatriating Sale Proceeds Back to Qatar
Selling Indian property from Qatar brings its own compliance step once the deal closes: getting the money out. TDS on an NRI's property sale generally applies at around 20% for long-term capital gains, or up to 30% for short-term gains, though this is reducible through a Lower or Nil TDS Certificate under Section 197 based on your actual computed gain rather than the sale price. Repatriation of the balance to your Qatar account is capped at USD 1 million per financial year from NRO account balances under FEMA, and requires Form 15CA — with Form 15CB certification where applicable — before your bank will release the transfer. One point in your favour as a Qatar resident: with no personal income tax at home, there is generally no separate Qatari-side filing on the capital gain, only the Indian-side TDS and repatriation compliance described above. Qatar is also a CRS-participating jurisdiction, so Indian financial accounts and assets reported under FATCA/CRS exchange mechanisms are visible to Indian tax authorities in the normal course — a reason to keep your property transactions properly documented and declared rather than a cause for alarm.
| Aspect | Key Point for Qatar-Based NRIs |
|---|---|
| TDS on Property Sale | Approximately 20% (long-term) or up to 30% (short-term) gains, plus surcharge and cess |
| Lower/Nil TDS Certificate | Available under Section 197 (Form 13), based on computed gain rather than full sale value |
| Repatriation Cap | USD 1 million per financial year from NRO balances under FEMA |
| Certification Needed | Form 15CA, and Form 15CB where the transaction requires it, before the bank remits funds |
| Qatar-Side Tax | No personal income tax, so generally no separate Qatari filing on the gain |
This is a brief overview — for the full mechanics of computing and remitting sale proceeds, see our dedicated guide on repatriation of funds for NRIs, and for the tax filing side, NRI income tax legal support.
Embassy of India, Doha — Jurisdiction Across Qatar
Unlike some larger Gulf states with more than one Indian mission, Qatar is compact enough that a single mission handles every part of the country:
| Indian Mission | Coverage Area |
|---|---|
| Embassy of India, Doha | All of Qatar — Doha, Al Wakrah, Al Khor, Al Rayyan, Mesaieed, Ras Laffan, and every other municipality |
Alongside the Embassy, the Indian Cultural Centre in Doha and community welfare bodies such as the Indian Community Benevolent Forum (ICBF) serve as familiar touchpoints for the Indian community in Qatar — often the first place NRIs turn to for guidance before a legal matter is formally referred to us.
NOTE
Consular appointment systems, jurisdiction and processing times change from time to time — always confirm current requirements on the official website of the Embassy of India, Doha before your attestation appointment. We can advise which attestation route best suits your property matter. For the full picture of our Qatar practice beyond property, see our NRI legal services in India for Qatar residents hub page.

Frequently Asked Questions (FAQs)
Can I fight a property dispute in India while living in Doha or elsewhere in Qatar?
Yes. Most matters are conducted through a properly attested Power of Attorney holder, video-conference consultations scheduled around Arabia Standard Time, and, where courts permit, video-recorded testimony -- meaning you can pursue or defend a property case, sign documents remotely, and stay updated through regular calls without needing to travel to India for routine hearings.
Can I use an apostille for my property Power of Attorney from Qatar?
No -- Qatar has not acceded to the Hague Apostille Convention, so a Power of Attorney executed in Qatar cannot be apostilled. It must instead be notarised in Qatar, attested by the Ministry of Foreign Affairs (MOFA), and then attested by the Embassy of India in Doha before it can be registered or used in an Indian court.
How long does the Qatar attestation chain take for a property POA, and what does it cost?
The full notarisation, MOFA and Indian Embassy chain typically takes two to three weeks and costs approximately QAR 400 to QAR 800. Signing directly at the Embassy's attestation counter often bypasses the separate MOFA step and can be completed in two to five working days.
Which Indian mission handles attestation and consular matters for Qatar?
The Embassy of India, Doha covers the whole of Qatar -- Doha, Al Wakrah, Al Khor, Al Rayyan, Mesaieed, Ras Laffan and every other municipality -- so there is no separate consulate to route to. Always confirm current requirements on the Embassy's official website before your appointment.
What does property title verification actually check before I buy in India?
A thirty-year title trace, the encumbrance certificate for existing mortgages or charges, mutation and revenue-record cross-verification, and a check for pending litigation, attachment or acquisition notices against the property -- plus RERA registration and builder approvals for under-construction units.
Someone has occupied or encroached on my ancestral property in India — what can I do from Qatar?
Where dispossession happened within the last six months, we can file a summary suit for recovery of possession under Section 6 of the Specific Relief Act without first proving title. For older or title-based disputes, we file a title-based recovery suit paired with an interim injunction to stop further sale or construction while the case is pending.
How much of the sale proceeds can I bring back to Qatar after selling property in India?
Repatriation from NRO account balances is capped at USD 1 million per financial year under FEMA, subject to TDS deduction and Form 15CA/15CB certification before your bank releases the transfer. A Lower or Nil TDS Certificate under Section 197 can reduce the tax withheld to your actual computed gain.
Does Qatar's lack of personal income tax affect my Indian property sale tax at all?
No. Qatar levies no personal income tax, so there is generally no separate Qatari-side filing on your capital gain, but the Indian-side TDS on the sale and FEMA repatriation compliance still apply in full, regardless of your tax position in Qatar.
My siblings in India and I in Qatar disagree on dividing our parents' property — what is the process?
This is resolved through a partition suit, which legally divides ancestral or jointly held property among the rightful heirs. Where a succession certificate or legal heir determination is also pending, that is typically resolved first so the partition proceeds on settled ownership.
