Because Saudi Arabia acceded to the Hague Apostille Convention on 8 April 2022 (effective 7 December 2022), a Power of Attorney executed in Saudi Arabia for use in India needs only a single apostille from the Saudi Ministry of Foreign Affairs (MOFA) — there is no separate Indian Embassy or Consulate attestation step required for most transactions. This is a meaningful advantage over the attestation-chain route still required in non-Hague Gulf states, and it is worth confirming with us, since some older guidance elsewhere online has not caught up with this.

Route 2 — Indian Embassy/Consulate Attestation (Still Available)

Some banks or Sub-Registrar offices, particularly those less familiar with the newer apostille route, may still ask for or accept Indian Embassy or Consulate attestation as an additional or alternative step. Where useful, we can arrange for the Power of Attorney to be signed in person at the Embassy of India or the Consulate General of India's attestation counter, where a Consular Officer or authorised agent witnesses the signature and attests the document directly. This route typically requires the signatory's original passport, Iqama, and a supporting photocopy. One meaningful advantage for Saudi Arabia-based NRIs, compared to counterparts in the USA, UK, Australia, or Canada, is that the Kingdom does not levy personal income tax on individuals. Salary, gratuity, and end-of-service benefits earned in Saudi Riyal are not taxed locally, and there is generally no domestic Saudi filing obligation or worldwide-income reporting requirement to worry about when it comes to rental income or capital gains earned on Indian property — a genuine simplification compared to jurisdictions where residents must declare and reconcile foreign income against a home-country tax return every year. Because Saudi Arabia does not tax salary income at all, the India-Saudi Arabia DTAA rarely needs to be invoked for individual employment income — there is simply no Saudi-side tax to offset against.

That said, this does not remove Indian-side tax obligations, which apply regardless of where you live. TDS on property sale by an NRI typically applies at around 20% for long-term capital gains, or up to 30% for short-term gains, reducible through a Lower or Nil TDS Certificate under Section 197. Repatriation of savings and sale proceeds to your Saudi Arabia bank account is capped at USD 1 million (or its equivalent) per financial year from NRO account balances under FEMA, subject to Form 15CA/15CB certification — even though the funds are ultimately converted into and used as Saudi Riyal.
