Three patterns come up again and again in conversations with clients calling us from Saudi Arabia. None of them are unusual — they are simply what happens when a genuinely valuable asset sits unattended for years at a time while its owner works abroad on a defined contract cycle.

  • Absentee ownership exploited while you're on a long Saudi work contract: A caretaker, tenant, or neighbour quietly changes locks, stops paying rent, or begins occupying land assuming an owner working in Riyadh or Jeddah will never notice, let alone act, before the situation becomes difficult to reverse.

Why This Matters

Section 6 of the Specific Relief Act, 1963 gives you a fast, low-evidence route to recover possession only if you act within roughly six months of losing it. Beyond that window, the same recovery requires proving title through a full civil suit under Sections 5 and 34 of the Act, usually paired with an interim injunction under Order 39 of the Code of Civil Procedure, 1908 — still achievable, but considerably slower. A Recent and Important Change: Saudi Arabia Now Apostilles Documents

Because Saudi Arabia acceded to the Hague Apostille Convention on 8 April 2022 (effective 7 December 2022), a Power of Attorney, or any other public document, executed in Saudi Arabia can be legalised with a single Apostille certificate issued by the competent Saudi authority — the Ministry of Foreign Affairs — instead of going through the older, multi-step Indian Embassy or Consulate attestation process. This puts Saudi Arabia in a materially different position from several of its Gulf neighbours, where embassy or consular attestation is still the only available route because those countries have not joined the Convention.

The Route We Use for Property Powers of Attorney

  • Drafting: We draft the POA in India, naming the specific property and the exact powers you are granting — for a sale, purchase, litigation, or mutation matter — and send it to you for review before signature.
  • Local Notarisation: You sign in the presence of the appropriate local notarising authority in Saudi Arabia, typically with witnesses, in whichever city you currently reside in.
  • Saudi Apostille: Since Saudi Arabia is now a member of the Hague Apostille Convention, the notarised POA is apostilled by the competent Saudi Ministry of Foreign Affairs — this single certificate is generally sufficient and avoids the older, slower Indian Embassy or Consulate attestation route.
  • Indian Embassy or Consulate Attestation (optional, where requested): For certain high-value transactions, or where a particular sub-registrar's office is more familiar with the older process, we can still arrange attestation through the Indian Embassy in Riyadh or the Consulate General of India in Jeddah as an additional step.
  • Courier & Registration: The original document is couriered to India, where your attorney-in-fact pays stamp duty and registers it at the local Sub-Registrar's office within the prescribed period.
